In every DWI case in NC the district attorney has to prove:

• You were driving on a street, a highway or a public vehicular area.
• That you were actually impaired or that you tested .08 or greater on the breath test at the station or on a blood test.
• The officer had the right to stop you or had the right to question you.
• The officer had probable cause to arrest you.
• All the procedures were followed in regards to your arrest and in regards to breath or blood testing.
• You were properly informed of your rights at the appropriate times in the process and you were not prevented from exercising those rights by the state's agents.
• You were treated fairly during the process.
